New LMIA Exempted Work Permit For Tech Talent in Canada

In line with its efforts to strengthen its position as a global tech leader the Government of Canada has introduced a new LMIA-exempted Work Permit under the Innovation Stream of the International Mobility Program.

This initiative is part of the Tech Talent Strategy launched in 2023 which was designed to attract skilled professionals to support Canada's growth in the Technological sector.

The new Canada Work Permit allows certain skilled foreign workers to apply for Employer Specific Permits if they receive job offers from companies participating in the Global Hyper Growth Project (GHP).

This initiative features 8 carefully selected companies recognised for their leadership and innovation potential within the industry. Most importantly these eligible workers can obtain a Labour Market Impact Assessment (LMIA) exempt work.

Eligibility Criteria for the New LMIA Exempt Work Permit Canada

To qualify for the innovation stream work permit applicants would need to meet the following eligibility criteria:

Secure a job offer from an employer involved in the Global Hyper Growth Project (GHP)
Obtain a job offer in a highly skilled occupation categorised under the National Occupation Qualification (NOC) TEER categories 0,1,2, or 3
Candidate must possess the required education and experience as outlined in the employment requirements of the NOC for the intended occupation
This opportunity is open to eligible candidates both within Canada and abroad.

Applicants hired for positions in TEER category 0 or 1 may benefit from expedited canada visa processing for their work permit.

However, before submitting the applications for the Innovation Stream employers need to meet a few specified responsibilities which include

Submitting an offer of employment
Paying a Compliance Fee of CAD 230
Providing the employee (prospective employee) with an offer of employment number.

Recent Changes in Canadian Work Permit Policies

The now introduced new work permit coincides with a recent update in restrictions related to work permits and LMIA processes.

On August 26th, the Canadian government announced the discontinuation of low-wage LMIA processing in certain cities where the unemployment rate exceeded 6%.
Exemptions would apply to sectors critical to food security such as primary agriculture, food processing, fish processing, as well as construction, and healthcare.
Additionally the government has reversed temporary covid era policies that allowed visitors in Canada to apply for job-supported work permits.
While visitors can still apply for various other work permits from within Canada the option for job supported permits with or without an LMIA is no longer available
