Foreign Workers in Canada Can Now Switch Jobs While Waiting for New Permits

In a notable shift to support skilled foreign talent already residing in the country, Canada has announced a new temporary public policy that streamlines job transitions for temporary foreign workers. Signed on March 4 and effective from May 27, this policy allows eligible workers to start new jobs before their new work permit applications are approved.
Previously, foreign workers faced long wait times for a new work permit in Canada, just to change jobs or employers, often resulting in income loss and staffing challenges for businesses. With the updated policy, workers under the Temporary Foreign Worker (TFW) Program or the International Mobility Program can take on new roles much faster once they secure a valid job offer.
Recognizing the essential contributions of temporary foreign workers, the Canadian government aims to provide greater flexibility in employment options. For reasons like layoffs, internal job changes, workplace issues, or for better opportunities, switching jobs becomes essential. With the new policy, workers now have a smoother path to continue contributing to the Canadian economy without prolonged job gaps.
Who Can Qualify for Canada’s New Temporary Public Policy?
The newly introduced temporary public policy offers much-needed flexibility for foreign workers holding closed work permits. It allows them to change employers while their new work permit application is still being processed, cutting down on delays.
Workers in sectors like IT, healthcare, agriculture, and caregiving can now pursue better roles or improved work conditions without facing long employment gaps. This policy aims to ease transitions, particularly for those with employer-specific permits.
To qualify for this temporary public policy, a foreign worker must,
- Be physically present in Canada and hold valid temporary resident status (including implied or maintained status).
- Have already submitted an application to obtain or extend a work permit.
- Have been authorized to work at the time their application was submitted.
- Intend to begin work in a new job or occupation as outlined in a formal job offer.
Foreign workers must actively apply for this exemption and clearly request its application while waiting for their new work permit decision. This request must be submitted through the IRCC web form and receive approval before starting any new job. Processing usually takes 10-15 business days, and under the revised policy, biometrics submission is now required.
